Terms of Use
This Agreement sets forth the terms and conditions of use of this Application provided by the Company. All users of this application must agree to and abide by these Terms of Use. If you do not agree to these Terms of Use, you must cease downloading, installing, and using this Application. By downloading, installing, or using this application, the user is deemed to have agreed to these Terms.
Responsibilities and Rights of Users
1. Users shall use this application at their own risk, and agree to be responsible for any and all acts that violate their obligations under these Terms of Use, any and all acts performed using this application, and any damages (including damages that we may incur) resulting from such acts.
2. The user's right of use is non-exclusive and may not be sublicensed to a third party, transferred, or succeeded to under the contractual status.
3. The equipment (including smartphones and tablets), network, and other environment for running this application shall be prepared at the user's expense and responsibility.
In-app Services
1. Usage Fees
This application is free of charge.
2. About targeted ad serving
We use IDFA to display behavioral targeting advertisements and provide it to the following third parties. IDFA will not be used to identify you.
If you wish to restrict advertising using IDFAs, please follow the instructions provided by Apple Inc. at the link below.
About this Function
1. Measure illuminance (lux) using the camera attached to the device (including smartphones and tablets).
2. For higher performance, we recommend using a high-performance illuminance meter. This application displays approximate values that can be calculated within the range of smartphone and tablet cameras. Please understand this in advance.
3. Other features are described in the app manual.
Prohibitions
In using this application, users shall not engage in any of the following acts. In addition, if any damage is caused to us or a third party as a result of the user's violation, the user shall be liable for compensation for such damage.
- Use of this Application by any method other than that approved by the Company
- Acts that violate laws, regulations, or public order and morals
- Criminal acts
- Use of this application for commercial or for-profit purposes beyond the scope of personal use
- Any act that interferes with or hinders the operation of this application
- Use of this application by impersonating a third party
- Any act that infringes on the copyrights, patents, utility model rights, design rights, trademarks, know-how, or any other intellectual property rights of the Company or any third party
- Acts of providing direct or indirect benefits to antisocial forces in relation to this application
- Engage in any other conduct that the Company deems inappropriate based on reasonable grounds
Indemnification
1. The Company does not guarantee the completeness, usefulness, guaranteed operation, fitness for a particular purpose, compatibility with the device used, or any other matters related to this application. In addition, the Company shall not be liable for any damages incurred by users or third parties due to communication failures, defects in system equipment, etc., failures, or use of this application.
Modification, Suspension or Termination of this Application
1. We reserve the right to change the contents, display, method of operation, management, etc. of this application, or suspend or terminate the provision of this application without prior notice to the user. In such cases, the Company shall not be liable for any events resulting from such changes, suspension, etc.
2. If a user violates any of the provisions of this Agreement, we may terminate this Agreement with such user and terminate the use of the Application for such user without any notice.
Changes to these Terms and Conditions
1. We reserve the right to change these Terms of Use without prior notice without obtaining the prior consent of users when we deem it necessary.
Governing Law and Jurisdiction
1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.
2. In the event that a dispute arises between the Company and a user in relation to these Terms of Use or this Application, the court having jurisdiction over the location of the Company's head office shall have exclusive jurisdiction.
